While the legislation was passed in 2004, it did not come into effect until 26 April 2005.

The legislation provided for the establishment of civil unions for different and same sex couples who did not wish to marry but still wanted a formal recognition of their relationship.

The Civil Union Act did not achieve full equality for the LGBTQIA+ community in New Zealand, but for many it was seen as an important first step in the fight for full marriage equality. In 2005, 249 civil unions were performed, with the first ceremony held on 1 May.

The debate and discussion that took place as part of the passing of the Act in 2004, laid foundations for the work that continued with the creation and passing of Marriage (Definition of Marriage) Amendment Act in 2013.
